Order in the Courtroom, Here Come the Stormtroppers

Lucasfilm Ltd is suing Andrew Ainsworth in London to stop him from selling Stormtrooper replica helmets and armor based on costume work he created for the films in 1976. Lucasfilm has already won court cases against Ainsworth in California.
Ainsworth claims that there was no formal contract signed between him and Lucasfilm in 1976. Therefore, he has the right to merchandise products based on his work. Lucasfilm contends that Ainsworth worked under an implied contract and that the design for the Stormtroopers was well established in 1975 and wholly owned by Lucasfilm. There is also some debate as to whether or not the armor is a work of industrial design or work of art which will affect copyright length.
So what, if anything, does this mean for the amateur prop makers? I’m curious why Lucasfilm is singling out this guy and not the thousands of other prop makers who sell Star Wars related gear. I guess if he’s promoting his armor as “Official Star Wars Hoo Ha” then double dumb ass on him.
